These Terms of Service are a contract between Wren Foundry and you. Wren Foundry operates Tintstep, the Chrome extension and the website at tinstep.wrenfoundry.com. Tintstep is a product of Wren Foundry.
The Extension License governs use of the extension on your computer. These Terms govern the website, an account, and fees. The Subscription Terms govern Pro. The Acceptable Use Policy is part of these Terms. The Privacy Policy and the Cookie Policy describe personal information. The Data Processing Addendum applies only when a business accepts it. Section 18 states which document controls if they conflict.
1. The service
Tintstep reads computed styles on a page you choose to inspect. The free tools work without an account. They include copying a color, a scan, contrast, and downloads. Pro is an annual subscription. During a paid period, a connected extension can build two files the free tools do not build: a computed-style file for one selected element, and a page report for a scan.
Wren Foundry may change the free tools or Pro. If Wren Foundry removes a Pro feature during a period you have already paid for, you may cancel and request a refund of the unused whole months in that period. The refund is the fee for that period, divided by twelve, times the number of whole months left after the feature was removed.
2. Assent
You agree to these Terms and the Subscription Terms when you create an account. The sign-up form requires that agreement. You agree to the Extension License when you install the extension. Before Wren Foundry takes a payment, the billing page requires the immediate-supply confirmation in the Subscription Terms, and Stripe shows the amount. Using the website after a change is posted is agreement to the change, as section 10 describes.
3. Eligibility and accounts
You must be at least 18 years old to create an account. The extension is not directed to children.
You will use an email address you control and a password of at least 10 characters. One email address holds one account. You may connect more than one browser that you use. You will not let another person buy Pro with your credentials.
You are responsible for activity on the account until you tell Wren Foundry that the password is compromised and Wren Foundry has had a reasonable chance to revoke website sessions. You may remove a connected browser from the account at any time.
4. Acceptable use
You will follow the Acceptable Use Policy. You will not use the website or the extension to break the law, to probe Wren Foundry's systems without written permission, or to send another person's private information when a description of the problem is enough. You are responsible for having the right to inspect a page you open.
5. License and intellectual property
Wren Foundry grants you a personal, non-exclusive, non-transferable, revocable license to use the website for your own work, subject to these Terms. The Extension License grants the license to the extension. Wren Foundry reserves every right it does not grant.
The Tintstep name, the mark, and the software belong to Wren Foundry or its licensors. You will not copy the extension's code except as the Extension License allows. You will not present another product as Tintstep, and you will not present Tintstep as a product of Google.
6. Your content and feedback
You keep what you inspect and what you export. Wren Foundry does not receive the page styles the extension reads, and it does not claim those pages or those exports.
You grant Wren Foundry a license to host, copy, and display a support message for the purpose of answering it and keeping the record described in the Privacy Policy. That license ends when the message is deleted, except for a copy that remains in a backup until the backup expires.
If you send a suggestion, Wren Foundry may use it without owing you payment or confidentiality. Do not send information you need held under a separate nondisclosure agreement.
7. Subscriptions, fees, and taxes
Paid use is governed by the Subscription Terms. The price, the billing period, and the renewal are shown before you pay. Stripe calculates tax at checkout. You authorize Stripe to charge the payment method you provide for the subscription and its renewal, as the Subscription Terms describe.
8. Privacy
The Privacy Policy describes how Wren Foundry handles personal information. It does not expand the license in section 5.
9. Support
Wren Foundry provides a contact form and reads mail sent to support@wrenfoundry.com. Wren Foundry does not promise a response time, an uptime percentage, or a particular outcome. Mail about verification, receipts, failed payments, and deletion is part of the account. Product notes are sent only if you opt in.
10. Changes
Wren Foundry may change these Terms. For a material change, Wren Foundry will post the new effective date and, if you have an account, email you at least 15 days before the change applies to you. If you do not agree, stop using the website and cancel a subscription before the change takes effect. A change required by law may take effect when it is posted.
The Extension License may be updated the same way for a new install. A copy you already installed keeps the license that shipped with that version until you install a newer one.
11. Suspension and termination
Wren Foundry may suspend an account that it reasonably believes is being used in breach of the Acceptable Use Policy, or that presents a security risk to other people. Wren Foundry will email the address on the account when it can do so without increasing the risk. You may appeal by replying to that notice. Wren Foundry will review the appeal. Wren Foundry does not promise reinstatement. A suspension does not erase a period you have paid for unless the breach is the payment itself.
You may delete the account as the product describes. Deleting the account cancels renewal of an active subscription, as the Subscription Terms describe. Page styles in the extension stay on your device. Uninstall the extension to remove them.
Sections that by their nature should continue remain in effect after termination, including unpaid fees, intellectual property, your content license for a remaining backup, disclaimers, liability limits, indemnity, and section 15.
12. Disclaimers
The extension reads computed styles that the browser reports. Pages change, browsers differ, and a value can be wrong for a purpose Wren Foundry did not test. A contrast figure is a calculation on the colors the scan could read. It is not a certification that a page meets WCAG.
Tintstep is provided "as is." Wren Foundry disclaims the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent the law allows. Wren Foundry does not warrant that the service will be uninterrupted or error-free.
Some laws do not allow a disclaimer of an implied warranty. In those places, the disclaimer applies to the extent the law allows, and the rest of these Terms remain.
13. Limitation of liability
To the extent the law allows, Wren Foundry is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or the cost of substitute software, even if Wren Foundry was told those damages were possible.
Wren Foundry's total liability arising out of Tintstep in a twelve-month period is the amount you paid Wren Foundry for Tintstep in that period, or 50 USD if you paid nothing. This cap covers the website, the account, and the extension together. The cap in the Extension License is the same cap, not a second one.
This limit does not apply to liability that cannot be limited, including liability for fraud, or for death or personal injury caused by negligence where the law forbids a limit. It does not take away a consumer right that cannot be waived.
The extension stores page styles on your device. Wren Foundry is not liable for a page style it does not hold.
14. Indemnity
If you use Tintstep as a business, you will indemnify Wren Foundry and its directors, employees, and contractors against a third-party claim arising out of your content or your use of Tintstep in breach of these Terms, including reasonable legal fees. If you are a consumer, this section does not require you to indemnify Wren Foundry for Wren Foundry's own breach or negligence.
15. Disputes and governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. A consumer protection that cannot be waived, in the country where you live, still applies.
The state and federal courts located in Delaware have exclusive jurisdiction over a dispute arising out of these Terms, and you consent to personal jurisdiction and venue there. A consumer may bring a claim in the courts of the country where the consumer lives when a non-waivable law of that country requires that forum. Wren Foundry may seek an injunction against misuse of the Tintstep name or software in any court that has jurisdiction.
These Terms do not require arbitration. They do not waive the right to participate in a class action.
Before you start a formal claim, email privacy@wrenfoundry.com and give Wren Foundry 30 days to try to resolve it. That wait does not apply to a request for an injunction against misuse of the Tintstep name or software, or when a shorter legal deadline would expire during the 30 days.
16. Export, sanctions, and government use
You will not use Tintstep if a sanctions law that applies to this service prohibits the transaction, including sanctions administered by the United States. Wren Foundry may refuse an account or a payment when a payment processor blocks it.
The website and the extension are commercial computer software. If a government agency uses them, it receives the rights a commercial user has under these Terms and the Extension License, unless a written addendum says otherwise.
17. Force majeure
Wren Foundry is not liable for a delay or failure caused by an event beyond its reasonable control, including a failure of a hosting, email, or payment provider, a denial-of-service attack, or an act of government. This section does not excuse a payment obligation or a data-protection duty that the applicable law does not excuse.
18. General
If these documents conflict, they control in this order: a non-waivable law; the Data Processing Addendum, on a point of data protection, when it has been accepted; the Subscription Terms, on a point of price, renewal, cancellation, or refund; the Extension License, on a point of local software use; these Terms, on a point of an account, a fee, or the website; the Acceptable Use Policy, on a point of conduct; the Privacy Policy and the Cookie Policy, on a point of personal-information practice. A description of a practice does not expand a license. For a single charge, the amount on the Stripe checkout page controls if it differs from the price stated in the Subscription Terms.
Wren Foundry may assign these Terms to a successor of the service. You may not assign them without Wren Foundry's consent. A consumer right that a mandatory law keeps with the consumer stays with the consumer.
A waiver must be in writing. A delay in enforcing a term is not a waiver. If a section is unenforceable, the rest remains. These Terms, the Subscription Terms, the Extension License, the Acceptable Use Policy, the Privacy Policy, and the Cookie Policy are the entire agreement about Tintstep. They replace earlier oral statements about the same subject. A purchase order you send does not add terms.
Notices to you may go to the email on the account. Notices to Wren Foundry go to privacy@wrenfoundry.com. A notice that the law requires to be mailed goes to [postal address].
